As with every other state in the US, after the passing of the 2018 Farm Bill, the growth, sale, and consumption of CBD-oil cultivated from industrial hemp is legal. CBD oil derived from marijuana containing no more than 0.3% THC has been legal in West Virginia since 2014. In 2019, governor Jim Justice signed a new law into effect that modifies the state’s hemp licensing program that ensures the sale of CBD in the state. This same law allows that hemp derived CBD products can be used in food cosmetics, personal care products, and animal products and won’t be considered an “adulteration” of the product. Again, since the manufacture of CBD is generally unregulated, many products marketed as “THC-free” may actually contain THC which can get you in trouble.
Once again, it is important to realize that all CBD products are technically considered illegal according to the federal government. In general, the existence of CBD in pretty much every state is due to a lack of enforcement of the law. In West Virginia specifically, you can still get in trouble for having CBD if you get pulled over and have any products on you. Additionally, you can be fired for failing a work-related drug test if you are using CBD. West Virginia is currently working to implement a medical marijuana program.
